Communications made by E-mail to this site will in no way be deemed to constitute legal notice to the Hamilton County Clerk’s Office or any of its employees with respect to any existing or potential claim or cause of action against the Clerk’s Office or any of its employees, where notice is required by any Federal, State, or local laws, rules or regulations.
Notice for Official Records
On or after October 1, 2002, *Any person preparing or filing a document for recordation in the Official Records may not include a social security number in such document, unless required by law. Any person has a right to request a county recorder to remove, from an image or copy of an official record placed on a county recorder’s publicly available Internet website or on a publicly available Internet website used by a county recorder to display public records or otherwise made electronically available to the general public, any social security number contained in an official record. Such request must be made in writing and delivered by mail, facsimile, or electronic transmission, or delivered in person, to the county recorder. The request must specify the identification page number that contains the social security number to be redacted. A fee may not be charged for the redaction of a social security number pursuant to such a request.
Notice for Court Records
“Any person preparing or filing a court document should not include a social security number or a complete bank account, debit, charge, or credit card number in such document, unless required by law or court rule, or necessary to the adjudication of the case.
Any person has a right to request that the Clerk of the Circuit Court remove from an image or copy of a court document a social security number or complete bank account, debit, charge, or credit card number contained in a court document. Such request must be made in writing and delivered by mail, facsimile, electronic transmission, or in person to the Clerk of the Circuit Court. The request must specify the case number, the title of the document, and the identification page number of the document which contains the number to be redacted. A fee will not be charged for the redaction of a social security number or a complete bank account, debit, charge, or credit card number pursuant to such a request.”
Concerning Clerk of Courts’ On-line Records and Services
This web site is provided by the Clerk of the Circuit Court in and for Hamilton County, Florida (hereinafter referred to as “Clerk”) as a public service.
Some of the services available on this site are offered without charge to the User. Other optional services are offered as a convenience to the public and are available as premium services to the User and for these optional and premium services the Clerk charges reasonable fees to the User.
This web site is intended for the private use of the public for general informational purposes only. The information available through this web site is not the official court record information of the Clerk, and should not be relied upon for any type of legal action. The official court record information is available only from the Clerk of the Circuit Court. The User is expressly prohibited from reproducing, publishing on-line, selling, reselling or otherwise disseminating data or information accessed pursuant to this Disclaimer Agreement, except as permitted by law. The information accessed is not intended or permitted to be used for commercial resale, except as permitted by law.
Availability of Data and Services
The information provided through this web site is extracted from the Clerk’s electronic records databases and is not the official records of the Clerk. Dissemination of the information accessed pursuant to this Disclaimer Agreement is subject to and controlled by United States Code and Florida Statutes, and court rules and court orders of the Supreme Court of Florida and applicable lower courts.
The information presented on this site is generally updated by 7:00 a.m. each day with the prior day’s entries but events may occur which delay the data updates and/or the web site’s availability. Therefore, the information available through this site is not warranted to be accurate or current. Only the official court records available from the Clerk of the Circuit Court should be relied upon as accurate and current. This web site is intended to be available seven days a week by twenty-four hours a day but the Clerk of the Circuit Court makes no guarantee in this regard.
The Clerk has taken reasonable actions to protect the security of information provided by the User when using the services provided through this site.
These actions include the use of Secure Socket Layer (SSL) and data encryption of sensitive data. The Clerk makes no guarantee in this regard.
Unauthorized Utilization and Alteration
Unauthorized access, utilization, disclosure or modification of exempted matters that fail to exist or have been breached or any alteration of any component of this site is expressly prohibited and is punishable as provided by law. Unauthorized attempts to upload or change information on this service are strictly prohibited and may be punishable under any and all applicable laws.
Limitation of Liability
Without waiving any other defenses or immunities provided by law, the Clerk shall not be liable for any demand or claim, regardless of form of action, arising out of or incident to the posting of information or data on this website, the accessing or use of any information or data on this web site, and/or the acts or omissions of any person or entity accessing or use of any information from this web site. This includes, but is not limited to, claims arising out of or incident to incorrect or incomplete data or information accessed pursuant to this Disclaimer Agreement. All users are advised to independently verify any information or data obtained pursuant to this Disclaimer Agreement with the official court record information reposing in the court files. User agrees that the services are provided “as is”; neither clerk, the custodians and/or their third-party providers make any representation nor warranty with respect to accuracy, completeness, or currentness; and they specifically disclaim any other warranty, express, implied or statutory, including any warranty of merchantability or fitness for a particular purpose. Neither the clerk, its officers, employees and agents, nor the custodians of records being accessed expressly or impliedly warrant that the information or data accessed by user is accurate or correct. There are no expressed or implied warranties in connection with this service. They shall not be liable on account of any such errors, omissions, delays, or losses. User agrees that in no event will clerk, the custodians and/or their third-party providers be liable for the results of user’s use of the services, inability or failure to conduct its business, or for indirect, special or consequential damages. The foregoing limitation of liability and exclusion of certain damages shall apply regardless of the success or effectiveness of other remedies.
User hereby relieves and releases Clerk, it officers, employees, agents, and the Custodians from liability from any and all damages resulting from interrupted service of any kind. Nothing in this agreement shall be construed as waiving the sovereign immunity of Clerk, its officers, employees and agents, and the Custodians.
Clerk’s Disclaimer or Warranties
The Clerk of the Circuit Court provides no warranties of any kind or nature, express or implied, and specifically disclaims any and all warranties of any kind or nature, express or implied, and specifically disclaims any and all warranties with regard to any computer programs, materials or services in connection with this web site. The Clerk diligently strives to maintain accurate, complete and timely data on this web site but shall not be liable for any consequential, exemplary, incidental or special damages arising from or in connection with data or information accessed via this site.
